OpenAI has requested the dismissal of Elon Musk’s federal lawsuit against the company, accusing it of being a harassment effort.

The ChatGPT company filed a motion for dismissal before a California federal court on Tuesday (October 8) which is the latest in the back-and-forth between the founders.

This all started when Elon Musk first sued OpenAI and its CEO Sam Altman in Spring of this year accusing the company of deviating from their foundational mission of creating artificial intelligence to benefit humanity. This was dropped just a short while later, in June.

Another lawsuit was then filed in August, with Musk claiming he was manipulated into co-founding OpenAI. The basis of this court action is that the ChatGPT maker allegedly “flipped the narrative and proceeded to cash in,” as the company soared on the proliferation and progress gained through generative AI.

Fast forward to this week and the company said in the court filing on Tuesday: “The suit is the latest move in Elon Musk’s increasingly blusterous campaign to harass OpenAI for his own competitive advantage.”

OpenAI and Elon Musk back-and-forth continues

Touching on Musk’s involvement in co-founding the company, the court filing reads: “OpenAI is dedicated to the safe and beneficial development of artificial general intelligence [AGI].

“Musk once supported OpenAI in that mission, but abandoned the venture when his bid to dominate it failed. Since launching a competing artificial intelligence company, xAI, Musk has been trying to leverage the judicial system from an edge.”

xAI was founded in March of 2023 and is self-described as being a “company working on building artificial intelligence to accelerate human scientific discovery. We are guided by our mission to advance our collective understanding of the universe.”

Elon Musk hasn’t yet publicly commented on the motion for dismissal, but it’s likely not the last time we will hear about the disputes.
